WE REPRESENT HOMEOWNERS AGAINST THEIR HOAs

HOA As A Matter Of Law…

Cal. Civ. Code § 4000 et. seq. governs common interest developments. Cited as the Davis-Stirling Common Interest Development Act, this body of statutory law provides the rules concerning HOA enforcement actions, amendments, operating rules, ownership rights and interests, governance, operations, alternative dispute resolution and civil actions.

An HOA is defined as “a nonprofit corporation or unincorporated association created for the purpose of managing a common interest development.” An HOA is made up of the members or owners of the individual units. And an HOA manages the property and conducts the business affairs of the common interest development.

Thus, each owner of a condominium unit in a condominium project is subject to the Conditions, Covenants and Restrictions (commonly referred to as the “CC&Rs”) as well as his/her own rights and limitations as a property owner. The CC&Rs are recorded with County Government and are covenants running in attachment to the land. Owners and the HOAs are bound by CC&Rs and property rights and limitations flow therefrom.

What We Do For Homeowners

Property rights disputes often arise as between homeowners and their governing HOA. Disputes also arise between the HOA and vendors, including contractors handling repairs and other construction related services at a multi-unit development.

Our HOA Dispute Attorneys have litigated cases on behalf of HOA members and HOAs. We now exclusively represent homeowners against HOAs. We do not litigate assessment lien disputes or foreclosure actions and California law limits an owner’s ability to challenge an HOA Board’s common area maintenance decisions. But if you are an owner and believe an HOA is trying to wield Board authority to inflict financial damage on you or is treating you differently from other owners, then we can help protect your interests.
