Many of our condo damage cases turn on whether the failure or loss causing the damage constitutes HOA property or separate interest property. Once the failed component is identified, a good place to start for the homeowner is the Condominium Plan. The Condominium Plan is typically recorded along with and in succession to the CC&Rs. The Condominium Plan will provide the technical and legal definition of the homeowner’s Unit’s boundaries. This Unit boundary is controlling. Thus, if the failed pipe, for example, is outside the boundary of the Unit, then it is within the boundaries of the common areas and liability would typically follow.
