HOAs and their property managers often times blame unit windows for leaks into the Unit. Even if owners swap out old windows for retrofit new windows, short of holes in the glass or faulty installation, the windows are probably not the problem. Many multi-family projects have stacked units with one common roof servicing multiple units which includes common gutters and water proofing systems. If the HOA is not maintaining clean and functioning gutters for example, then that can lead to excessive water potentially compromising window headers and other exterior components that allow water to intrude through the windows or make water leaks manifest in or around windows. It’s easy to blame the windows in these situations however, homeowners should hold their HOAs accountable for a proper investigation into any water intrusions into the unit and show the owner that the cause of the water intrusion is in fact a window failure as opposed to exterior failures.
Don’t let HOAs bully you into thinking the leak is your fault. Owners can’t control the common spaces or repair them for that matter.
